受益人證明(beneficiary's certificate):是一種由受益人自己出具的證明，以便證明自己履行了信用證規(guī)定的任務(wù)或證明自己按信用證的要求辦事，如證明所交貨物的品質(zhì)、證明運(yùn)輸包裝的處理、證明按要求寄單等。件，一般無(wú)固定格式，內(nèi)容多種多樣，以英文制作，通常簽發(fā)一份。
二、受益人證明的基本要求
1. 單據(jù)名稱。這種單據(jù)的名稱因所證明事項(xiàng)不同而略異，可能是寄單證明、寄樣證明(船樣、樣卡和碼樣等)、取樣證明、證明貨物產(chǎn)地、品質(zhì)、嘜頭、包裝和標(biāo)簽情況、電抄形式的裝運(yùn)通知、證明產(chǎn)品生產(chǎn)過程、證明商品業(yè)已檢驗(yàn)、環(huán)保人權(quán)方面的證明(非童工、非獄工制造)等。
2. 證明上通常會(huì)顯示發(fā)票號(hào)、合同號(hào)或信用證號(hào)以表明與其它單據(jù)的關(guān)系。
3. 證明的內(nèi)容應(yīng)嚴(yán)格與合同或信用證規(guī)定相符。
4. 因?qū)儆谧C明性質(zhì)，按有關(guān)規(guī)定證明人(受益人)必須簽字。
5. 單據(jù)一般都應(yīng)在規(guī)定的時(shí)間內(nèi)做出。
三、常見證明的內(nèi)容和要求
1. 寄單證明(beneficiary’s certificate for despatch of documents)。是最常見的一種，通常是受益人根據(jù)規(guī)定，在貨物裝運(yùn)前后一定時(shí)期內(nèi)，郵寄/傳真/快遞給規(guī)定的收受人全套或部分副本單據(jù)，并將證明隨其它單據(jù)交銀行議付。如certificate from the beneficiary stating that one copy of the documents called for under the lc has been dispatched by courier service direct to the applicant within 3 days after shipment.
2. 寄樣證明(beneficiary’s certificate for despatch of shipment sample)。例如：certificate to show that the required shipment samples have been sent by dhl to the applicant on july 10， 2005(受益人只要按規(guī)定出單即可)。
3. 包裝和標(biāo)簽證明。例1：某信用證要求：a certificate from the beneficiary to the effect that one set of invoice and packing list has been placed on the inner side of the door of each container in case of fcl cargo or attached to the goods or packages at an obvious place in case of lcl cargo，其意思是受益人應(yīng)證明已把一套發(fā)票和箱單貼在集裝箱箱門內(nèi)側(cè)(整箱貨)或拼箱貨的顯眼的地方;例2：beneficiary certificate in triplicate stating the shipment does not include non-manufactured wood dunnage，pallets，crating or other packaging materials;the shipment is completely free of wood bark，visible pests and signs of living pests(要求三份單據(jù)，證明貨物未再加工、非木制包裝、無(wú)樹皮、無(wú)肉眼可見蟲害、無(wú)活蟲)
4. 其它規(guī)定。如certificate confirming that all goods are labelled in english(貨物加貼英文標(biāo)簽);beneficiary’s certificate stating original b/l of 1 set carried by the captain of the vessel(一套正本提單已交由船長(zhǎng)攜帶) ;a statement from the beneficary evidencing that packing effected in 25kgs ctn(貨物25公斤箱裝); beneficiary’s certificate confirming their acceptance of the amendment dated 10/09/2005 made under this credit q
quoting the relevant amendment number(確認(rèn)改證內(nèi)容);certificate to show goods are not of israeli origin and do not contain any israeli material(貨物須保證非以色列產(chǎn)并且不含以色列的材料)。
四、注意事項(xiàng)
1. 單據(jù)名稱應(yīng)合適恰當(dāng)。
2. 一般的行文規(guī)則是以所提要求為準(zhǔn)直接照搬照抄，但有時(shí)也應(yīng)做必要的修改。如信用證規(guī)定“beneficiary’s certificate evidencing that two copies of non-negotiable b/l will be despatched to applicant within two days after shipment”，在具體制作單據(jù)時(shí)應(yīng)將要求里的“will be despatched”改為“have been despatched”;再比如對(duì)“beneficiary’s certificate stating that certificate of manufacturing process and of ingredients issued by abc co should be sent to sumitomo corp”的要求，“should be sent”最好改為“had/has been sent”
3. 證明文件通常以“this is to certify”(或declare，state，evidence等)或“we hereby certify”等開始。
五、實(shí)例分析

2. beneficiary’s certificate certifying that beneficiary has faxed the shipping docs(b/l, invoice, packing list ,phytosanitary certificate)within 2 working days after shipment date to applicant and the relate certified true copy of fax對(duì)這樣的受益人證明應(yīng)做到：發(fā)貨后兩日內(nèi)傳真發(fā)送有關(guān)單據(jù)給申請(qǐng)人，傳真報(bào)告應(yīng)證實(shí)并向銀行提交。
3. two sets of shipping samples and one set of non-negotiable shipping documents must be sent to applicant by speed post/courier service within 5 days from the date of bill of lading and a certificate to this effect from beneficiary together with relative speed post/ courier receipt must accompany the documents。該要求的意思是：兩套船樣和一套不可議付的裝運(yùn)單據(jù)須在提單日后5日內(nèi)通過郵局快遞寄給開證人，受益人證明應(yīng)表明已照此行事，相應(yīng)的郵政快遞收據(jù)
